Q3. What is an omnibus hearing?
Answer: An omnibus hearing is a pretrial hearing on evidentiary issues in felony and gross misdemeanor cases. If this hearing is "uncontested," it is usually held within two weeks of the arraignment. If this hearing is "contested," with a need for testimony, it will usually be held no sooner than four to six weeks after the arraignment because these contested hearings have to be assigned to a specific district court judge. Dahlen contested Omnibus hearing Prosecutors and their two defense attorney’s approached the bench for an “off the record” discussion... (could only hear bits and pieces)
Defense requesting a dismissal for lack of probable cause
Defense discussed the Affirmative defense (Judge reminded them off and on the record that is a defense, not reason to dismiss, separate issues)
Defense argued it is “hard for us to move forward” without the girls statements In Camera, CPS records (CPS was involved after they were found)
Judge to prosecutor....”I don’t like this....the way....(could not hear the rest)
Defense: we don’t know where discovery is, clients had not intent to keep the girls from father, No intent to deprive of parental rights, the girls were dropped off, it was their understanding only for a few days, Gina has training in dealing with abused kids on a daily basis (Note: At no time are Dahlen's attorneys talking about filing sanctions against Keena for wasting the rigged court's valuable time, the Dahlen's valuable time or the valuable time of the Dahlen's attorneys, are they? They aren't, are they?)

Is it the defenses intent to do joint hearings with Doug and Gina Dahlen? Yes
Judge advised if they change their mind at any point in the hearing they can request separate hearings, asking if they understood, Dahlens shook their heads in the affirmative.
First the Motion to compel discovery/ disclosure defense requested:
1. Foster care records (of the time the girls were in foster care directly after being found)
2. Interview In Camera with Judge Knutson who was Judge on custody/ dissolution matter
3. ALL CPS records (before and after girls went missing)
4. Custody evaluations
5. Psychological evaluations
6. Records from the reunification center the girls went to in CA
(Note: I've got an audio recording of Sandra's attorney, Stephen Grigsby, making wild & outrageous claims that you can't file for sanctions in a criminal case, don't I? I do, don't I?)
Judge argued relevancy of those documents, dated before and after the girls stay at the Dahlens, stating when using the affirmative defense only relevant Dahlens observations of the girls while in their care, their state of mind, if they understand the children to be fearful
Defense indicated that the girls told Dahlens that if they forced them to go home to David Rucki, they would only run away again
Judge “you can’t use [the above requested docs] to ‘bolster’ –that is the wrong word...to discover what others did”
Puppet prosecutor argued on the Judges lead “the information requested” because it occurred before and after the girls stay at the Dahlens
CHIPS case opened after the girls were found occurred in November 2005 found no endangerment, and b/c David Rucci was pursuing this reunification therapy in CA, they were returned to their fathers home (SO, prosecutor was privy to these records) She argued she does not believe there are additional CPS records.
There was some argument about 902 disclosure , any information from Dissolution is confidential
It seemed that there was a previous decision that “the parent” David Rucci has a say in if records are released, and the girls are interviewed In Camera. (Note: my emphasis added) (Note: Conspicuously missing is the testimony from law enforcement officers about the facts being relied upon for probable cause; the statements taken from the defendants; and/or about evidence seized from the defendants, right? Hard to call witnesses if you don't have the evidence, right? Must be why Poor Dede kept on demanding the preliminary audio statements for the state's witnesses even on the last day of her Show Trial, right?)
Note: Alls sorts of time and consideration for the Dahlen's attorneys and the complete opposite for Poor Dede, right?
Judge took the matter under advisement, except she was going to order CPS release the report from after the girls were found, review and decide if there is relevant information, seal the rest for “appellate purposes”
Court will take defenses request for dismissal under advisement. Next addressed was the Constitutional Motion
Defense argues (I believe I got this down right) Article 1 section 15
Defense used case law Murphy v Murphy and Hurshburger (SP) one and two and State of Mn v Miller, which is a Wisconsin case
Defense argues Dahlens are “faith based” and referenced their mission statement of their nonprofit agency. Cited Acts 529
Defense again indicate that the girls were only supposed to be there for a few days, Gina is trained extensively in truancy issues, sex crimes, abused children
Defense argues some case law (I believe referenced above) regarding Amish (liberty of conscience) defendants following different rules due to religious beliefs, Dahlens “follow Gods law not man’s law”
Defense takes issue with “intent to conceal” Girls in plain view, Dahlens told girls that they would not lie for them, no effort to hide children, they would get their hair done in community, attended church, went to Fargo shopping, went to local restaurants. When police came asking after the girls, Doug told police they were there and allowed them into the home.
The Elizabeth Smart case was cited, to which judge stated, “Let me get this straight, because the girls were not locked in a closet, there was no intent to conceal?”
Court asked if the girls were homeschooled, Defense indicated yes. Judge asked, “don’t people that homeschool children need to register them as such?” then the Judge stated, “people in the audience are shaking their heads” (In the affirmative)
Judge “Why couldn’t they be charged for harboring a runaway vs deprivation of parental rights with intent to conceal?”
Defense again brought up no probable cause, they want police reports, investigative evidence, Gina Dahlen and Dede Evavold emails were listed as part of discovery, but not provided to Dahlens
Both will provide the court with briefs/ memorandums by May 23 and the judge will take this under advisement.
Judge “we are moving forward, but will allow the defense to revisit probable cause.
Prosecutor “It has always been the states position that the girls were not runaways.”
Judge “I am assuming the Dahlens are sharing discovery.” Defense team “Yes, no sense in having the state make to copies...cost of two copies.” Judge “You can charge co-counsel for fees.” Defense: “ I would charge him more than the state would.” Chuckles....
(Note: It's not about getting the client their evidence or justice, is it? It's all about milking the client for as much money as possible, right? That's right, isn't it? FYI: According to the Minnesota Government Data Practice Act all electronic data is free, isn't it? It is, isn't it?)
Prosecutor: “The State is most concerned with the Dahlens place in adult responsibility for making decisions when they have been brainwashed.”
Judge: “We will not set this matter on for trial just yet. We will address some of the issues and then schedule a case management conference and set a game plan.” Dede’s hearing was heard last at approximately 12:30
Judge: “Are you representing yourself?”
Dede: “yes”.
Judge: “Are you an attorney?”
Dede: “No”. (Note: my emphasis added)
Note: Dahlen's trial not even put on the calendar and Poor Dede's rigged trial is rushed onto the calendar, isn't it? And with Poor Dede not having a single electronic of her readily available, free, electronic, criminal investigative data either, right? That's right, isn't it?
Judge goes into her options AGAIN with regard to representation (this was addressed at her first appearance), “You can hire your own attorney, represent yourself, get a public defender with a nominal fee. You would file what is called In Forma Pauperis which is a Latin term.”
Dede “The state is refusing to provide me with my discovery.”
Prosecutor: “ We have sent her a bill, and given her the option to come into our office and review it.” Ms. Evavold is reporting myself and members of my office to the MN Board of professional responsibility.” (Note: Dede actually filed a criminal complaint with the corrupt Hastings Police department. The complaint was also emailed to the Lawyer's Professional Responsibility Board & the First Judicial District Court Administrator)
Dede: I received a bill for $210.00 and then it was reduced to 91.00. I can get this electronically from the state which would cost them nothing, or on disc in which the fee would be minimal. There is no rule regarding charging me for my discovery. I have asked for an itemized breakdown justifying the fees and the state refuses to respond to this.”
