STATEMENT OF PROBABLE CAUSE


Your complainant is employed by the Fridley Police Department. In that capacity, complainant has reviewed official police reports filed by Fridley Police Officers Tyler Abrahamson and Nico Wallat and has learned substantially the following:

On Thursday, June 2, 2016, at approximately 3:05 a.m., Officer Abrahamson and Officer Wallat responded to the 7600 block of University Ave NE, on a report of a vehicle that struck multiple signs as it was traveling westbound on Osborne Road NE, within the City of Fridley, Anoka County, Minnesota. Dispatch advised the officers that the citizen caller stated that the vehicle turned south onto University Avenue NE where it veered into the median and became stuck.

Upon arrival, officers observed a black pickup truck, MN plate 934KMZ, stuck in the median. The truck had significant wheel and axle damage. Officer Wallat observed a downed street sign and matching silver truck step-plate in the 300 block median of Osborne Road NE as well as two additional damaged street signs in the 600 block median of Osborne Road NE. The citizen caller advised he observed the dark colored pick- up truck driving westbound in the eastbound lane of Osborne Road NE before jumping the curb and striking several street signs. The truck turned left onto University Avenue NE before losing control and getting stuck in the median ditch.

Officer Abrahamson made contact with a male, who exited the vehicle and walked towards the officer. The male was identified by Minnesota driver's license as CHRISTOPHER ALAN DAAS, D.O.B. 06/24/1976, the defendant herein. While standing next to defendant, the officer could smell the strong odor of an alcoholic beverage coming from defendant's breath. Defendant had bloodshot, watery eyes. When asked how much he had to drink, defendant stated "too much". When asked for his driver's license, defendant exhibited poor finger dexterity and dropped his license on the ground. Defendant refused to perform field sobriety tests or submit to a PBT. Defendant was placed under arrest for DWI.

After being read the Minnesota Implied Consent Advisory and being given an opportunity to consult with an attorney, defendant refused to take a breath test to determine an alcohol concentration.
